Restored Lives Behavioral Health Policy:
Privacy, Informed Consent, and Ethical Standards

1. Purpose

 

This Policy describes how client information is collected, used, stored, protected, and disclosed in accordance with the BACB Ethics Code for Behavior Analysts,  the Georgia and Texas Licensing Boards, and applicable laws and regulations. The goal is to protect client dignity, rights, and privacy at all times.

 

2. Confidentiality Commitment

 

All information related to clients is treated as confidential. Confidential information includes, but is not limited to:

  • Identifying information

  • Assessment results

  • Treatment plans and progress data

  • Session notes and reports

  • Communications with clients and caregivers

Information is only accessed or shared when it is professionally necessary, ethically permitted, and legally allowed.

 

3. Informed Consent

 

Prior to collecting or using client information, informed consent is obtained from the client or their legal guardian. This includes consent for:

  • Assessment and treatment

  • Data collection and storage

  • Communication methods

  • Collaboration with other professionals

Consent may be withdrawn at any time, except where disclosure is required by law.

 

4. Use of Client Information

 

Client information is used solely for purposes related to:

  • Providing behavior-analytic services

  • Monitoring progress and outcomes

  • Supervising and training staff (with safeguards to protect identity when possible)

  • Fulfilling legal, ethical, or funding requirements

Information is not used for non-professional purposes.

 

5. Disclosure of Information

 

Confidential information is not disclosed without written consent except in the following circumstances:

  • When required by law (e.g., abuse or neglect reporting, court orders)

  • To prevent serious and foreseeable harm to the client or others

  • For professional consultation or supervision, with reasonable steps taken to protect client identity

  • For billing or insurance purposes, using the minimum necessary information

 

6. Data Protection and Storage

 

Reasonable steps are taken to protect client records, including:

  • Secure physical storage (locked cabinets, restricted access)

  • Secure electronic storage (password protection, encryption where applicable)

  • Limited access to authorized personnel only

Client records are retained and disposed of in accordance with applicable laws and ethical standards.

 

7. Electronic Communication

 

Electronic communication (e.g., email, telehealth platforms, data systems) may involve privacy risks. Clients are informed of these risks, and reasonable safeguards are used to protect confidentiality. Sensitive information is shared electronically only when necessary.

 

8. Client Rights

 

Clients and/or legal guardians have the right to:

  • Access their records as permitted by law

  • Request corrections to inaccurate information

  • Receive an explanation of privacy practices

  • Ask questions or raise concerns about confidentiality

 

9. Ethical Compliance

 

All services and privacy practices are conducted in alignment with the BACB Ethics Code for Behavior Analysts. Any suspected breaches of confidentiality are addressed promptly and appropriately.
